Divorce Do's and Don'ts

Everyone knows that the divorce process is not a walk in the park for most people. Divorce can be a very emotionally trying time for everyone involved and you may find yourself thinking or saying things that you normally wouldn't. Parents especially must work to keep their emotions in check during the divorce if they have little children watching. When children are involved in the divorce process, it becomes much more complicated and it must be dealt with in a sensitive manner. The divorce transition can be especially difficult, which is why it is vital that you actively work to make logical decisions, rather than acting rash and getting caught up in the moment. With divorce, you must think in terms of doing unto others as you would want done to you. With that in mind, here are some of the top divorce Do's and Don'ts from our Birmingham divorce attorney.

Do's- What You Should Do During a Divorce Case

  1. Do consult with an experienced attorney who has experience with family law and divorce cases
  2. Do offer full disclosure with your attorney by ensuring that they are fully informed about your case. Don't hide any important details.
  3. Do try and be flexible so you and your spouse can reach a compromise, this will make the process go much smoother.
  4. Do keep a journal and write down all important events and the date which they occurred.
  5. Do seek professional help from a counselor if you are having difficulty coping with the divorce transition.
  6. Do allow the children to maintain a regular, consistent schedule and social life so that they can have a sense of stability and normality.
  7. Do act civil and speak to your spouse in a respectful manner in front of your children.
  8. Do reinforce the reason for the divorce and make sure that the children don't blame themselves.
  9. Do make an effort to make the children feel at home so they don't feel like guests in your house.

Don'ts- What You Shouldn't Do During a Divorce Case

  1. Don't put your children in the middle of the divorce as messengers between you and the other parent.
  2. Don't refuse to let the other parent see the children just because they haven't paid child support. Let the court enforce the court order and don't take things into your own hands.
  3. Don't fight with the other parent in front of the children.
  4. Don't represent yourself in a divorce case. You are not familiar with the laws and the rights that you hold.
  5. Don't be late on your child support or spousal support payments. The court has penalties and ways of enforcing court orders.
  6. Don't pick up drinking or bad drug habits to cope during this difficult time.
  7. Don't bring new people home that you are dating to meet your children. It is always better to date when the children are with the other parent.
  8. Don't be late when picking up or dropping off the children with the other parent.
  9. Don't talk to your children like you would a therapist. Putting your problems on them will only make their lives more difficult.
  10. Don't bring up things from the past. Leave them there and try to move forward.
  11. Don't respond in the moment. Think about how your actions will impact tomorrow.
  12. Don't act out violently against your ex-spouse. All that will do is endanger your chances of obtaining child custody or visitation.
