This appeal involves a worker's compensation lawsuit brought by Dale Jackson against Blair Logistics, LLC in Jefferson Circuit Court. Jackson sought benefits following an injury he allegedly suffered while at work. Blair, denying the existence of an employer/employee relationship and citing the doctrine of forum non conveniens, petitioned for a transfer of the lawsuit to Chilton County, claiming it to be a more appropriate venue.
Blair argued that Jackson resided in Chilton County and the alleged incident and subsequent medical treatment primarily took place there. However, the trial court denied Blair's motion to change venue. On appeal, the Court of Civil Appeals of Alabama denied Blair's petition reasoning that Blair had not demonstrated that Jefferson County, where Blair's primary place of business is located and where Jackson's treatment for his alleged injury primarily occurred, was unsuitable or inconvenient.
